PRIVACY POLICY
Oyster Farm LLC (“Oyster Farm”) has established this Privacy Policy (the “Privacy Policy” or “Policy”) to explain to you how your information is protected, collected, and used. This Policy may be updated at any time by Oyster Farm. Oyster Farm will provide notice of materially significant changes to this Privacy Policy by posting notice on the Oyster Farm website (“Site”) and/or the Oyster Farm Application (“Application”). By using the Site and/or Application, you agree to all terms in this Privacy Policy and the Terms of Use, which is incorporated by reference. All capitalized terms not defined in this Policy will have the definition as stated in the Terms of Use.

Protecting Your Privacy.
Oyster Farm makes every reasonable attempt to protect your private information. Oyster Farm will not share your personal information with third parties for marketing purposes.
Oyster Farm, or Commercial Businesses who post on Oyster Farm, may provide links to third party websites, which may have different privacy practices. Oyster Farm is not responsible for, and does not have any control over, the privacy policies of those third-party websites, and encourages all users to read the privacy policies of each and every website visited. -
Use of Site and/or Application by Minors.
Oyster Farm does not knowingly collect any information from persons under the age of 13 years of age. All Members of Oyster Farm must be over the age of 18. -
Data Oyster Farm Collects.
Oyster Farm may collect the following data:- legal name;
- email address;
- physical contact information, including physical legal address and phone number;
- financial information, including your EIN if you register on behalf of a business and/or your social security number if you register on behalf of yourself for purposes of sending information to you, the Internal Revenue Service, and your state and local taxing authorities, if required;
- financial information including credit card information if released by the entity that charges your credit card should there be a membership fee;
- bartering transactional information;
- billing and other information you provide to purchase an Oyster Farm membership, should there be a membership fee;
- dispute resolution, correspondence through [email protected];
Oyster Farm sometimes collects your email address, for purposes such as sending confirmation emails or authenticating your accounts. By signing up as a Member you are consenting to receiving emails from Oyster Farm.
Oyster Farm sometimes collects your phone number for account authentication purposes, and may transmit it to a third-party service for verification.
Oyster Farm collects your social security number or employer identification number (EIN) for reporting financial transactions to the appropriate taxing authority as required by law. You will receive a 1099-B yearly with financial information. This will be provided to you electronically unless you request a written copy.
Oyster Farm may receive your credit card information, if necessary for any reason, from the credit card processor which is typically either Apple or Google depending on whether you download the Application from the Apple Store or Google Play Store as your membership is typically created, and potentially paid for, through the relevant app stores rather than the Site and/or Application.
Oyster Farm is not responsible for any misuse of information by a third-party and the use of Oyster Farm services is governed by Oyster Farm’s privacy policy and Terms of Use available at www.oysterfarm.org.
Oyster Farm may collect personal information if you provide it in feedback or comments or if you contact Oyster Farm directly. Additional any information posted on the Application is not confidential. Please do not post anything on the Application that you would like to keep private.
Oyster Farm’s web logs collect standard web log entries for each page served, including your IP address, page URL, and timestamp. Web logs help Oyster Farm diagnose problems with our server, to administer the Oyster Farm Site and/or Application, and to otherwise provide Oyster Farm’s service to you. In addition, Oyster Farm may collect other information from your interaction with our Site and/or Applications, services, content, and advertising, including computer and connection information, statistics on page views, traffic to and from the Site and/or Applications, advertising data, IP address, demographic and navigational data, and standard web log information. This information may be obtained for Oyster Farm from a third-party provider. Oyster Farm may use this information for marketing, commercial, or any other purpose as Oyster Farm sees fit. -
Data Oyster Farm Stores.
All information posted to the Application, including account information, is stored in Oyster Farm’s database, even after "deletion," and may be archived elsewhere.
Oyster Farm’s web logs and other records are stored indefinitely. This may include the goods and services you bartered using Pearls and your browsing history.
Although Oyster Farm makes good faith efforts to store the information in a secure operating environment that is not available to the public, Oyster Farm cannot guarantee complete security.
Oyster Farm may store information in an off-site location and/or cloud service, which may or may not be located in the United States and may not be bound by the laws of the United States. -
Archiving and display of Oyster Farm’s webpages by search engines and
other sites.
Search engines and other sites not affiliated with Oyster Farm - including Google.com, Bing.com and Yahoo.com - archive or otherwise make available Oyster Farm’s webpages. Oyster Farm has no control over third-party archiving and search engine sites and cannot guarantee the accuracy of any information stored by search engine sites. -
Circumstances in which Oyster Farm may release information.
Oyster Farm may disclose information about its users if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process.
Oyster Farm may disclose information about its users to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms of Use; respond to claims that any posting or other content violates the rights of third parties; or protect the rights, property, or personal safety of Oyster Farm, its users, or the general public.
Oyster Farm may disclose information about payment information if there is a dispute over payments made through Oyster Farm or to Oyster Farm.
Oyster Farm does not disclose your information to third party marketing or email organizations.
Oyster Farm may disclose your information to other business entities, should Oyster Farm plan to merge with or be acquired by that business entity.
Oyster Farm discloses financial information to the relevant taxing authorities which may include your local, state and federal taxing authorities if required by law. This includes, but is not limited to, information required to be submitted via a 1099-B form to the IRS and potentially sales tax and payroll tax information, if required, to your local and/or state and federal taxing authorities. -
Cookies.
A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. We use cookies to help us identify and track visitors, their usage of our websites, and their website access preferences. Users who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using our Site, with the drawback that certain features of our Site may not function properly without the aid of cookies.
